Terms of Service

1. Who we are

Scenily ("Scenily", "we", "us") is an AI video creation platform operated by Lynx Group GmbH, Kaiserstuhlstrasse 2, 8154 Oberglatt, Switzerland. These terms govern your use of Scenily. By creating an account or using Scenily you accept them on behalf of yourself and the organization you use it for.

2. Accounts

  • You sign in with Emorise Login, our central sign-in service (including sign-in with Google or Microsoft where offered). You are responsible for keeping access to your sign-in method secure.
  • Each account belongs to an organization (workspace). The organization owner and admins manage members, roles, billing and connected AI accounts, and are responsible for the actions of the members they invite.
  • You must provide accurate information and be at least 18 years old or of legal age where you live.

3. Plans, billing and cancellation

  • Scenily requires a monthly subscription. Prices and included credits are shown on our pricing section and in the app. Payments are processed by Stripe; we do not store your card details.
  • Subscriptions renew automatically each month until cancelled. You can cancel at any time on the credits page of the app; the cancellation takes effect at the end of the current billing period and you keep access until then.
  • We may change prices with reasonable advance notice; changes apply from your next billing period.

4. Credits

  • AI generation steps consume credits at the rates shown in the app before you start the step.
  • Credits included in a subscription are granted each billing month and expire at the end of that month; unused subscription credits do not roll over.
  • Credits bought as one-time credit packs do not expire.
  • Credits have no cash value, cannot be transferred outside your organization and are non-refundable, except where a refund is required by law. If a generation fails on our side, the credits for it are returned to your balance automatically.

5. AI-generated output

  • Scenily uses third-party AI models to generate text, images, video and audio. Output can be inaccurate, unexpected or similar to output generated for others. Review it before you publish or rely on it.
  • As between you and us, you own the content you upload and, to the extent the law allows, the output you generate. You grant us a limited licence to host, process and render your content solely to provide Scenily to you.
  • You are responsible for how you use the output, including any advertising and consumer protection rules.

6. Acceptable use

You must not use Scenily to create, upload or distribute content that:

  • is illegal, defamatory, harassing, hateful, sexually explicit involving minors, or promotes violence;
  • infringes copyrights, trademarks or other rights of third parties, including material you have no licence for;
  • depicts or imitates a real person's face, body or voice without that person's consent, or is designed to deceive viewers about who said or did something;
  • is misleading advertising or otherwise violates the usage policies of the AI providers we use.

We may screen generation requests and output automatically, block content that violates these rules, and suspend accounts that repeatedly or seriously violate them.

7. Your own AI accounts (Pro and above)

On Pro and higher plans, an organization can connect its own AI provider accounts (for example API keys for OpenAI, Anthropic, Google, fal.ai or ElevenLabs, or a ChatGPT sign-in) so that covered steps run on those accounts instead of consuming credits.

  • You are responsible for your own provider accounts, keys and sign-ins, and for complying with each provider's terms and usage policies, including whether your ChatGPT plan permits use through Scenily.
  • Usage on a connected account is billed to you by that provider under your agreement with them. We are not responsible for provider charges, limits, outages or changes on your accounts.
  • We store connected credentials encrypted and use them only to run AI steps for the organization that connected them. You can disconnect them at any time in the workspace settings.
  • If you enable the fallback setting and a connected account fails (for example a rejected key or a reached limit), the step runs on our platform account and consumes credits at its normal price. If the setting is off, the step fails instead. Some steps (such as draft video, export, content screening and storage) always use credits or our platform.

8. Availability and changes

We work to keep Scenily available but do not guarantee uninterrupted service. AI providers and models may change or become unavailable; we may replace them with comparable ones. We may change these terms; we will notify you of material changes in advance by email or in the app.

9. Termination

You can delete your account in the app at any time. We may suspend or terminate accounts that violate these terms. After termination, your projects and generated media are deleted as described in our Privacy Policy.

10. Liability

To the extent permitted by law, we are not liable for indirect or consequential damages, lost profits or lost data, and our total liability is limited to the fees you paid in the twelve months before the claim. Liability for intent and gross negligence remains unaffected.

11. Governing law

These terms are governed by Swiss law. Place of jurisdiction is the seat of Lynx Group GmbH, subject to mandatory consumer protection rules.
